Below is the letter CNCA sent to Senators addressing concerns over the Dietary Supplement Safety Act of 2010. Please feel free to use part, or this entire letter, in your correspondence to your Senators. We urge you to take action today!
Dear Senator:
This is to strongly urge you to oppose the Dietary Supplement Safety Act of 2010 (S. 3002). It is an example of well-intentioned legislation failing miserably to achieve its purported goals, leaving in its wake an expensive regulatory burden for both FDA and industry, including many companies in our state. Worse, it puts safe and valuable dietary ingredients at risk of being removed from the market.
FDA already has the regulatory tools necessary to protect the public health; they simply need more resources devoted to enforcement.
Senator, the short story is this: every industry has a "Bernie Madoff". Instead of promulgating burdensome, costly regulations that will do nothing to meaningful to prevent adulteration, please give FDA the resources to amplify enforcement of the existing regulations. Put the bad guys out of business, sue them, send them to jail, preferably all three.
